TERMS AND CONDITIONS OF TRAVEL

These Terms and Conditions (“Agreement”) govern the relationship between KING SIGNATURE SAFARIS LIMITED (hereinafter “the Company,” “We,” “Us,” or “Our”) and the traveler (hereinafter “the Guest,” “You,” or “Your”).

By placing a booking request, making a payment, or confirming an itinerary, you acknowledge that you have read, understood, and agreed to be bound by these terms.

1. THE NATURE OF OUR SERVICES

KING SIGNATURE SAFARIS LIMITED operates as a professional safari tour operator and Destination Management Company (DMC).

  • Service Provider: We own and operate vehicles and employ professional guides. For these services, we act as the Principal.

  • Agent: We facilitate bookings with third-party suppliers (Lodges, Hotels, and Airlines). For these services, we act as an Agent. All third-party bookings are subject to the specific terms of those suppliers, which are incorporated herein by reference.

2. DEPOSIT AND PAYMENT TERMS
  • Non-Refundable Deposit: A 20% non-refundable deposit of the total invoice amount is required at the time of booking to secure reservations.

  • Additional Deposits: Certain items, such as gorilla/chimpanzee trekking permits or specific high-demand partner properties, may require immediate 100% payment or higher deposits, which will be advised at the time of booking.

  • Final Payment: The remaining 80% balance is due no later than 60 days prior to the date of arrival.

  • Last-Minute Bookings: Any booking made within 60 days of arrival requires 100% immediate payment to confirm services.

  • Default: The Company reserves the right to cancel any booking where payment has not been received by the due date, with the forfeiture of all monies previously paid.

3. CANCELLATION AND REFUND POLICY

Cancellations must be received in writing. Because the Company incurs costs and loses the ability to resell space upon cancellation, the following penalties apply:

  • 61+ days before arrival: Loss of the 20% non-refundable deposit.

  • 31 to 60 days before arrival: 50% of the total invoice amount is forfeited.

  • 0 to 30 days before arrival: 100% of the total invoice amount is forfeited.

  • No-shows and Early Departures: No refunds will be given for unused services, late arrivals, or “no-shows.”

4. GUEST PARTICIPATION, HEALTH, AND SAFETY
  • Physical Condition: The Guest acknowledges that safari travel involves visiting remote areas and can be physically demanding. It is the Guest’s responsibility to ensure they are medically fit for the itinerary.

  • Medical Disclosure: Guests must notify the Company of any physical disability, medical condition, or dietary restriction at the time of booking.

  • Guide Authority: The Company’s guides and third-party camp managers have absolute authority regarding safety. Guests must strictly follow instructions regarding wildlife interaction. Failure to comply may lead to immediate expulsion from the tour without refund.

5. TRAVEL DOCUMENTS AND INSURANCE
  • Passports & Visas: Guests must ensure their passport is valid for at least six months beyond the end of the tour and possess all necessary visas and health certificates (e.g., Yellow Fever). The Company is not responsible for any Guest being denied entry to a country.

  • Mandatory Insurance: Comprehensive Travel Insurance is a mandatory condition of travel. It must cover trip cancellation, medical expenses, emergency evacuation, and personal baggage. KING SIGNATURE SAFARIS LIMITED is not liable for any costs or losses that would have been covered by such insurance.

6. TRAVEL LOGISTICS AND BAGGAGE
  • Bush Flights: Domestic flights in small aircraft have strict weight limits (typically 15kg / 33lbs per person) and require soft-sided bags (no frames or wheels). Excess luggage may require the purchase of an additional seat or a private charter at the Guest’s expense.

  • Check-in Times: Guests are responsible for adhering to check-in times for all flights and transfers. The Company is not liable for missed connections due to Guest lateness.

7. PRICE VARIATIONS AND STATUTORY CHARGES

The Company reserves the right to increase the tour price after a booking is confirmed in the event of:

  • Government-mandated increases in VAT, Park Fees, or Tourism Levies.

  • Significant fuel surcharges for transportation.

  • Statutory increases that are beyond the Company’s control.

8. LIMITATION OF LIABILITY AND INDEMNITY
  • Inherent Risks: The Guest acknowledges that safari travel involves inherent risks, including interaction with wild animals and travel in undeveloped areas.

  • Indemnity: To the maximum extent permitted by Tanzanian law, the Guest holds KING SIGNATURE SAFARIS LIMITED, its directors, and employees harmless against any claim for personal injury, death, delay, or loss of property, unless caused by the gross negligence or willful misconduct of the Company.

  • Force Majeure: The Company is not liable for failure to perform due to “Acts of God,” war, civil unrest, strikes, or pandemics. In such cases, the Company will endeavor to provide credits for future travel, but cash refunds are not guaranteed.

9. PHOTOGRAPHY AND MARKETING

The Company reserves the right to take photographs and videos during the tour for promotional use. Guests who do not wish to appear in marketing materials must inform the Company in writing prior to the commencement of the safari.

10. GOVERNING LAW AND DISPUTE RESOLUTION

This Agreement is governed by the laws of the United Republic of Tanzania. Any dispute arising from this Agreement that cannot be settled amicably shall be submitted to the competent courts of Arusha, Tanzania.
